HELICOPTER CRASH IN THE GULF
After a helicopter crash in the gulf, numerous reports from different news outlets are telling a story of a flight gone wrong while landing on an oil rig. On this episode of Legal Roundup, Pepper brings a special guest on the show to talk about the different aspects of law relating to the incident.

While determining what it could mean for the case of the accident, they go over wrongful death, maritime law, and even product liability. After all, oil rigs usually have a helipad at the top of their structure, leaving plenty of landing clearance for incoming transports.
OFFSHORE ACCIDENTS
Offshore workers, like the ones that work on oil rigs, towboats, fishing boats, and other vessels, risk their lives every day while working at sea. Whenever negligence causes a worker to suffer an injury while on the job, they can pursue compensation under maritime law.
However, there are certain vessels that do not have protection under maritime law, but there are other regulations that do protect the workers of those vessels without coverage.
Legal doctrine such as the Jones Act and Longshore and Harbor Workers’ Compensation Act provide compensation to workers for being disabled or injured on the job while on the navigable waters of the US, or areas used for loading, unloading, building, or repairs.
AVIATION ACCIDENTS
Even though this particular helicopter crash in the gulf is more of an offshore accident, it still classifies as an aviation accident as well. Aviation accidents are incidents relating to the flight of a piloted or non piloted aircraft that can happen any time between boarding and landing, in which the aircraft strikes another object.
Unfortunately, most aviation accidents can be catastrophic and result in serious injuries or death, in some cases. What if the reason for the crash was another cause unrelated to the pilot or landing pad?
There are cases of other helicopter accidents caused by manufacturing defects of certain parts or by illegitimate repairs.
PRODUCT LIABILITY
In cases like this, product liability falls upon the manufacturer of defective equipment in the case of an accident that results in an individual’s injury or death. Without proper design and manufacturing, equipment and parts can fail when a product is in use.
There are also cases of product litigation where a product was dangerous for use and listed no warning labels or instructions on the packaging or item itself. Improper handling of the item falls on the liability of the manufacturer in this case for not having clear warning labels.
