Race Discrimination

Racial discrimination is when a person is treated less favorably than another person in a similar situation because of their race, color, descent, national or ethnic origin or immigrant status.

Title VII Law

Title VII is the body of law that prohibits discrimination in the workplace, including discrimination based upon race. It is important to recognize that Title VII places some strict deadlines on when a claim can be asserted. Often, an employee who waits too long will be barred from bringing a Title VII claim.

Section 1981 Law

That is where Section 1981 comes into play. Although it applies only to race discrimination, Section 1981 has a significantly longer deadline, meaning that although a discrimination claim may be time-barred under Title VII, it may be possible to bring essentially the same race discrimination claim under Section 1981.
