Time is important when you are hurt in a car wreck! In the State of Mississippi you only have three (3) years from the date of the accident to file a civil suit against the one who hurt you. Attorneys call the one who hurt you, the tortfeasor, and rightfully so as that person committed a tort against you.
A tort is “a wrongful act or infringement of a right leading to a civil legal liability,” according to the Oxford Dictionary. Negligence is a tort whereby the tortfeasor had a duty of care that was owed to you from the perspective of a reasonable person, says the Oxford Dictionary. Thus, a person following you in a vehicle has the duty to keep their vehicle under control at all times and not rear-end your vehicle.

The tort of negligence has a three statute of limitations, but there are other torts that have only a one year statutes of limitations. However, for our purposes here, we are focused on the tort of negligence which has three years.
For example, if you are hurt on October 31, 2016, then you have three years from that day to October 31, 2019 to file suit against your tortfeasor. After the three years have passed, then you are barred from filing suit. In other words, your case is forever lost and cannot be filed against the tortfeasor. Hence, the tortfeasor walks away with no liability against him or her, and can never be held liable for the act of negligence.
